Section 1. Authority is hereby granted to Francisca Rose, widow of laborer Marcelo Dalida, together with her two minor children, to maintain an action in the Court of First Instance of Capiz against the Government of the Philippine Islands to determine the liability which may correspond as indemnity for damages on account of the death of said laborer Marcelo Dalida, which took place in a cement tube on the public work of the concrete bridge over the Capiz River, Capiz, as a result of the falling of a piece of iron from the upper part of said tube on said laborer; and the Attorney-General of the Philippine Islands is likewise authorized and directed to appear in behalf of the Government in said action:— Provided, That this Act shall not be construed in any manner so as to waive any defense which the Government of the Philippine Islands may have on the date of the enactment of this law.
