AN ACT TO AMEND SECTION TWO HUNDRED AND NINETY-NINE OF THE ADMINISTRATIVE CODE, ELIMINATING THE PROHIBITION THAT PER DIEMS OR SUBSISTENCE EXPENSES BE PAID TO JUDGES OR AUXILIARY JUDGES OF COURTS OF FIRST INSTANCE.

Section 1. Section two hundred and ninety-nine of the Administrative Code is hereby amended to read as follows:

"

Section 299.

How to be paid. -Travel expenses shall be allowed either in the form of payment of the travel expenses actually and necessarily incurred, or in the discretion of the chief of Bureau or head of Office, by the payment of per diems, or fractional per diems, in lieu of expenses other than transportation.

"Per diems shall not be allowed to members of field parties or others for whom subsistence in kind is supplied or other special provision made to cover travel expense.

"When travel is done by water and subsistence is not included in the transportation the amount actually and necessarily expended for subsistence shall be paid, and no per diem shall be allowed in lieu thereof."

Section 2

Section 2. This Act shall take effect on its approval, with retroactive effect since January first, nineteen hundred and nineteen. ℒαwρhi৷
