Executive Order No. 507 (1992)

Section 1. Transfer of Appropriation for Devolved Services and Facilities to the Internal Revenue Allotment. Of the amounts appropriated under the 1992 General Appropriations Act for the following functions, projects and activities of indicated devolution-affected departments and agencies of the national government, such sums shall be transferred to the Internal revenue allotment of local government units as may be necessary to comply with the provisions of Section 284 of the Code:

a. Functions and locally-funded projects of the Commission on Population, Fiber Industry Development Authority, National Agricultural Fishery Council, Livestock Development Council and National Meat Inspection Commission; and,

b. Location-specific national government offices, programs, projects and activities such as the Sacobia Development Authority and the Kalinga Special Development Authority, Development Coordinating Activities for Leyte and Samar by— the Office— of— the President,— the— Nueva Ecija Integrated Rural Development Project and the Bula-Minalabac— Integrated— Development— Project— of— the Department of Agrarian Reform and the Palawan Upland Support Services of the Department of Agriculture.

Allocation of the Internal Revenue Allotment to Local Government Units

Section 2.

Allocation of the Internal Revenue Allotment to Local Government Units. The level of the Internal revenue allotment to be released to the local government units in 1992 shall be P28 billion. This amount shall be allocated among the provinces, cities, municipalities and barangays in accordance with the following arrangement and schedule:

A. The P18.08 billion direct appropriation shall be immediately augmented by P1.63 billion representing the transferred appropriations for the devolved capital outlay projects, net of reserves, of the Department of Agrarian Reform (P0.01 billion), the Department of Agriculture (P0.05 billion), the Department of Environment and Natural Resources (P0.6 billion), the Department of Health (P0.05 billion), the Department of Public Works and Highways (P1.46 billion. The resulting P19.71 billion Internal revenue allotment shall be prorated in accordance with the formula prescribed under Section 284 of the Code and released to the concerned local government units on a quarterly basis.

B. The P8.29 billion balance shall cover the cost of functions, projects and activities, inclusive of the personal services requirement, which shall be devolved by national government agencies within six months after the effectivity of the Code. This amount shall be apportioned among and released to local government units in accordance with the devolution process prescribed under Executive Order No. 305: Provided, however, that this provision shall be effective only for Fiscal Year 1992, thereafter, appropriations for the cost of functions, projects and activities, inclusive of the personal services, of the devolved national government functions shall be provided for in the General Appropriations Act, after due consultations with the local government units and the national government agencies concerned.

Preparation of Revised Local Annual Budgets for Fiscal Year 1992

Section 3.

Preparation of Revised Local Annual Budgets for Fiscal Year 1992. Local. Government Units shall revise their respective 1992 Annual Budgets which have been earlier enacted or deemed reenacted pursuant to the provisions of the repealed Presidential Decree No. 477 to reflect the following changes made by the Code:

A. Any fund or resources available for the use of the local government units shall first be allocated for the following basic devolved services and facilities before applying the same to other items of expenditure:

i. Construction, improvement, repair and maintenance of local roads;

Construction and improvement or concrete barangay roads and multi-purpose pavements;

ii. Payment or Personnel Economic Relief Allowance (PERA)in the amount of P500.00 a month per employee in accordance with the terms and conditions prescribed under the General Appropriations Act;

Payment of honoraria or barangay chairmen not exceeding Pl,000 a month and of barangay councilors, treasurers and secretaries each not exceeding P600 per month including the Pl,000 Christmas bonus for each barangay chairman, councilor, treasurer and 8ecretary pur8uant to R.A. 7160;

v. Land and home development improvement— projects devolved by the Department of Agrarian Reform;

vi. Procurement and distribution of certified seeds, purchase, expansion and conservation of breeding stocks, construction, repair and rehabilitation of water impounding systems and procurement or fishing net8 and other materia1s supportive or fishermen devolved by the Department of Agriculture;

vii. Establishment— of new— forest— plantations— and maintenance— and protection of— existing— forest plantations— devolved— by— the— Depart8ent— of Environment and Natural Resources;

ix. Construction, rehabilitation and repair of devolved provincial health office/district/municipal / medicate community hospitals and other facilities of the Department of Health, including purchase of medical equipment; and,

x. Implementation of water supply and communal irrigation project8 devolved by the Department of Public Works and Highways;

B. All other requirements and limitations provided for under Title Five of Book II of the Code shall be strictly observed. 7!ᕼdMᗄ7

Implementing Rules and Regulations

Section 4.

Implementing Rules and Regulations. The Secretary of Budget and Management shall issue such rules and regulations as may be necessary to implement the provisions of this Order.

Effectivity, This Order shall take effect immediately
