[ MEMORANDUM ORDER NO. 38, October 29, 2025 ]
AUTHORIZING THE EXECUTIVE SECRETARY TO SIGN "BY AUTHORITY OF THE PRESIDENT" THE GRANT OR DENIAL OF PETITIONS FOR EXECUTIVE CLEMENCY INVOLVING ADMINISTRATIVE PENALTIES IMPOSED UPON PUBLIC OFFICIALS IN THE EXECUTIVE BRANCH
WHEREAS , the President, in the exercise of his power of supervision and control over all Executive departments, exercises discretion to grant executive clemency involving administrative penalties imposed upon officials in the Executive branch; WHEREAS , in the case of Llamas vs. Orbos (G.R. No. 99031, 15 October 1991), the Supreme Court held that the President's executive clemency powers are not limited to criminal cases but likewise extends to administrative cases in the Executive Branch of the Government. WHEREAS, Book III, Title 3, Chapter 9, Section 27 (10) of the Administrative Code states that the Executive Secretary shall "exercise primary authority to sign papers 'By authority of the President,' attest executive orders and other Presidential issuances unless attestation is specifically delegated to other officials by him or by the President;" NOW, THEREFORE, I, FERDINAND R. MARCOS, JR. , President of the Philippines, by virtue of the powers vested in me by law, do hereby confirm the authority of Executive Secretary Lucas P. Bersamin to sign "By Authority of the President" the grant or denial of petitions for executive clemency for commutation or removal of administrative penalties and/or disabilities imposed upon officials in the Executive branch This Memorandum Order shall take effect immediately.
